2.

Offer Period, Place & Outlet Coverage

  • Offer shall commence from the customer's Impact Zero® Ultimate Case and Screen Protector Bundle (Ultimate Bundle) purchase date stated on a valid invoice submitted (Purchase Date).
  • Offer is valid for Australia and New Zealand only and shall be available on purchases of products from approved 3sixT Gear resellers only. Purchases of the Ultimate Bundle made on Gumtree and other 2nd hand re-selling websites are not valid.
  • 3sixT Gear reserves the sole right to reject claims and annul the claim at its own discretion.

3.

Product Coverage ('Product Devices')

  • The Offer shall be applicable for the Ultimate Bundle when used in the proper manner on the:
    • Apple iPhone 14 Series
    • Apple iPhone 15 Series
    • Samsung Galaxy S23 Series
      *This list is subject to change as new devices are launched.

4.

Eligibility Criteria

  • The Offer is only redeemable by customers who are using the Ultimate Bundle in a proper manner. We must be able to confirm and verify that there was proper usage of the Ultimate Bundle when the device was damaged.
  • By purchasing and registering to the Impact Zero® Ultimate Bundle Replacement Program you are automatically agreeing to all terms and conditions laid out by 3sixT Gear herein in relation to the program (3sixT Gear hold veto on all claims).
  • Customers are required to activate the new Ultimate Bundle, the Impact Zero® Case and the Screen Protector within 14 days of the Purchase Date.  Failing to register within the said period (day count) can potentially result in device screen replacement registration being declined (at 3sixT Gear’s sole discretion).
  • Devices that are received for repair that are (a) pin-protected and (b) have not been factory reset, will be returned to the customer at the customer's cost.
  • 3sixT Gear will reject packages that have not been packed and dispatched as per the packing steps detailed during the claim process. Packages will either be rejected or will be returned to the customer at their cost.
  • Devices that are received and found to have the Ultimate Screen Protector product applied on top of a factory-fitted screen protector will be rejected and returned to the customer at their cost.

5.

Offer: Device Screen Replacement / Unlimited Screen Protector Replacement

  • 3sixT Gear will support no more than two (2) device repairs or replacements claimed within a two (2) year period, which commences from the Purchase Date.
  • 3sixT Gear will cover a "damaged device " due to an Ultimate Bundle or Impact Zero® Case when used in conjunction with the Ultimate Screen Protector failure only.
  • "Damaged device " means broken external parts of the device due to impact or a drop but not damage caused by water, heavy machinery or high impact damage due to a fall over 6 metres.
  • In the event that the phone stops working without signs of physical damage after a drop, and the manufacturer warranty deems the damage due to a fall, internal damage will be covered.
  • Any damage deemed by the manufacturer warranty as a device fault or defect will not be covered.
  • Pre-existing damage to older devices will need to be declared at registration and will not be covered by the replacement/repair agreement.
  • 3sixT Gear will only replace the damaged device if the device is so damaged that a repair is not possible.
  • 3sixT Gear will only offer product replacement and device repair if the registration form has been completed correctly and in full.
  • 3sixT Gear will support Ultimate replacements to valid and approved claims made under the Impact Zero® Ultimate Screen Protector Warranty Terms and Conditions found at https://www.3sixtgear.com/pages/ultimate-screen-protector-terms-and-conditions (at 3sixT Gear's sole discretion).
  • In the event that an approved repair claim is granted and a subsequent repair is performed, 3sixT Gear shall require a submission of a valid tax invoice from the Customer as evidence of payment for the services rendered by an authorised repair centre.

    • Authorised Repair Centres are officially recognised by Apple or Samsung, and are specifically identified on the manufacturers' official websites as Authorised Service Providers or Repair Centres.
    • 3sixT Gear shall reimburse the customer, for the repair expenses incurred, subject to a maximum amount as specified in the manufacturer's official recommendations for repair costs.

6.

Redemption of Device Screen Replacement / Unlimited Screen Protector Replacement

  • Customers will require their individual registration codes to complete the claim process. This registration number will be in the form of your device’s SERIAL NUMBER and issued to you via the originally registered email address which states it as being ‘conditionally’ approved (pending final approval upon additional documents/proof to support the claim).
  • Customers must initiate and follow the steps to complete their claim via 3sixTgear.com designated 'Impact Zero® Ultimate Program Claims' section (Claims Form).
    • Customers can claim for Impact Zero® Ultimate Screen Protector Replacement.
  • Identified or suspected fraudulent activity will be reported to local authorities or 3sixT Gear contracted agencies for further investigation & communications between 3sixT Gear and the party associated with the perceived fraudulent claim will subsequently cease immediately.

7.

Registration & Verification of the Documents

  • Product registrations will require the following information:
    • Full Name
    • Physical Address
    • Email Address
    • Mobile Phone Number
    • Device Model Name
    • Device Serial Number
    • Device IMEI Number
    • Date of Purchase
    • Proof of Purchase – to be uploaded as an attachment via the Registration and Claims Form.
    • For iPhone 14 and Samsung Galaxy S23 Bundles – Photo evidence of correct application of the Ultimate Screen Protector AND device fitted with the Impact Zero® Case – to be uploaded as an attachment via the Registration and Claims Form.
    • For iPhone 15 Bundles – Photo evidence of correct application of the Ultimate Screen Protector, Lens Protector AND device fitted with the Impact Zero® Case – to be uploaded as an attachment via the Registration and Claims Form.
  • All information inputted and submitted will be conditionally approved, pending further investigation by a 3sixT Gear representative vs our database when a claim is finally submitted for review. At this point, your documents will be scrutinised to validate the claim submitted.
  • Customers must provide photographic verification of their device screen to ensure the correct application of the Ultimate Screen Protector (on a damage-free device screen prior to applying the screen protector) AND demonstrate that the device is correctly fitted with the Impact Zero® Case and Lens Protector (iPhone 15 only). This verification is essential to ensure that the screen protector, case and lens protector (iPhone 15 only) meet the necessary standards of quality and functionality, enabling its inclusion in the Ultimate Bundle Replacement Program.
  • If further information is required, a 3sixT Gear representative will contact customers via email provided to gather outstanding information to close off the claim or registration.
  • In the event that any documents/invoices are found to be false/fabricated or the original invoice is lost/printed/torn to the point of unrecognition/understanding, the Customer is obligated to provide a legible version so the claim process can continue. Pending claims awaiting legible versions will remain open until the Customer provides this information.

8.

End of Life ('EOL') Products

  • End of Life (EOL) refers to the discontinuation of any 3sixT Ultimate Screen Protector, Ultimate Bundle, or Impact Zero® Phone Case by 3sixT. 
  • Products are made EOL up to 5 years after the initial device availability. 3sixT reserves the right to determine at its discretion that a product is no longer available, taking into account limited inventory availability.
  • For customers enrolled in the Ultimate Program (Ultimate Screen Protector and/or the Ultimate Bundle) who process a successful claim for products considered EOL, will receive a refund of the original cost of the product and will be unable to process any further repair claims. 

9.

Forfeiture Clause

  • Once fraudulent Customer activity is identified, the Customer will be 'blacklisted' and not be eligible for inclusion in current or future 3sixT product offerings.

10.

Privacy/Data

  • The Customer agrees that 3sixT Gear will collect and store personal data attributed to the registration of the Ultimate Bundle, or the Impact Zero® Case when used in conjunction with the Ultimate Screen Protector, and other products/services it offers. The collection and provision of collected information are subject to privacy laws in Australia. 3sixT Gear will comply with its Privacy Statement in dealing with any personal information.
  • 3sixT Gear will hold historic customer data procured in the product registration process for up to two (2) years before responsibly purging it from its databases/systems.
  • The Customer does not have to provide us with any personal information. It is solely at the Customer's discretion whether they purchase 3sixT Gear products, services or receive communications. If the Customer chooses not to provide personal information necessary for the completion of the registration or claim process, we will be unable to provide the service offered and may decline to deal with you altogether.
  • The Customer can request access to procured personal information by contacting our Privacy Officer. We will provide you with access once you have proved your identity. If your request is unusual or onerous, you may be required to pay us a fee before we provide you access to your personal information. If your personal information is incorrect or you wish us to delete it, contact our Privacy Officer (privacy@cellnet.com.au) to update or delete it. Upon this occurring, we will be unable to provide the service originally offered and may decline to deal with you altogether.

11.

Publicity

  • The Customer unconditionally consents to access/use of contact information (email address and mobile number primarily) of participants (if any, clicked or shared by Customer during registration) by 3sixT Gear or its authorised agency for media coverage, advertisement or publicity for present and future communications without any further consideration to the participant including promotion of its products.
  • The Customer can cancel and or unsubscribe their inclusion of 3sixT Gear marketing/promotions at any time via the originally received content. Please look for the unsubscribe links included.
  • The unsubscribe process can take up to two (2) weeks to be actioned.

12.

General Conditions

  • The customer agrees that 3sixT Gear shall not be liable in any way for any personal or business claims, costs, injuries, losses or damages of any kind arising out of or in connection with the product or service offered.
  • 3sixT Gear reserves the right to change, alter and modify the Terms and Conditions of this product offering at any given point at its sole 3sixT Gear without giving any reason whatsoever.
  • 3sixT Gear reserves the right to substitute the Ultimate Bundle, or the Impact Zero® case when used in conjunction with the Ultimate Screen Protector, offering with other gift(s) of equivalent value under this product offering at its sole discretion without giving any reasons.
  • 3sixT Gear holds no liability or responsibility for lost inbound or outbound device shipments. 3sixT Gear will make every effort to follow up and investigate lost outbound shipments with couriers.
  • 3sixT Gear will make every effort to process to turn around approved and received device screen replacements within a 14-day period (2 weeks).
    • Additionally, reimbursements to customers for valid and approved claims will be diligently processed within a period of 45 days from the date of the repair invoice provided by the customer, as reasonably practicable.
    • 3sixT shall not be liable for any unforeseen delays caused by disruptions, losses, damages, computer-related malfunctions, or general failures which affect the participation of the customer.
  • Failure by 3sixT Gear to enforce any of its rights at any stage does not constitute a waiver of those rights.
  • 3sixT Gear complies with the Australian Privacy Principles (“APPs”) which regulate how we collect, use, disclose, store and protect your personal information.
  • In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the product offering, these terms shall prevail over all such other instructions, rules and conditions.
  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If permitted by law, our liability for a breach of such guarantee is limited to (at our option), in the case of goods:
    • the replacement of the goods or the supply of equivalent goods;
    • the repair of the goods;
    • the payment of the cost of replacing the goods or of acquiring equivalent goods; OR
    • the payment of the cost of having the goods repaired, and, in the case of services:
      • the supplying of the services again; OR
      • the payment of the cost of having the services supplied again.
  • The benefits given by this warranty are in addition to your other rights and remedies under a law in relation to the goods or services to which this warranty relates.
  • Other than as expressly provided under this warranty and subject to the provisions of the Australian Consumer Law to the full extent permitted by law, 3sixT Gear:
    • excludes all other conditions, guarantees, rights, remedies, liabilities, representations, warranties and other implied or express terms, conferred by statute, custom or the general law that impose any liability or obligation on 3sixT Gear, including but not limited to any implied warranties of non-infringement, loss of or damage to devices, data, security, performance, that the functions contained in the product will meet your requirements, or that defects in the product will be corrected, or that your use of the product will generate reliable results; excludes all liability for the loss of, or damage to, devices and data caused by use of a 3sixT Gear product, or its repair;
    • excludes any liability it may have to you for:
      • loss of income, revenue or profit;
      • loss or damage to any third-party devices, products, software or services, AND
      • any indirect, consequential, special, incidental or punitive loss or damages (including but not limited to loss of use, data, business interruption or cost or procuring substitute services or products), which arises under any law (including the law of negligence) and relates to your use, or inability to use a 3sixT Gear product, or any related services.
    • This exclusion applies even if 3sixT Gear has been advised of the possibility of such damages and even if any warranty or remedy provided under this manufacturer’s warranty fails of its essential purpose; and limits its monetary liability to you, under any law, to the price that you paid for the 3sixT Gear product (as applicable).
  • References above to ‘indirect, consequential, special or incidental losses’ shall mean any losses which
    1. were not reasonably foreseeable by both parties; and/or
    2. were known to you but not to 3sixT; and/or
    3. were reasonably foreseeable by both parties but could have been reasonably prevented by you.

13.

Jurisdiction

  • Decision of 3sixT Gear in relation to the product offering and matter incidental thereto shall be final and binding on the customer. All disputes shall be governed by the laws of Queensland, Australia. These Terms shall be governed by exclusive laws of Queensland, Australia and the courts located in Queensland shall have the exclusive jurisdiction in respect of all the subject matter with relation to the product service offering.
